At StreamYard, we are committed to responding to and acting upon notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act (“DMCA”).

We also reserve the right to terminate the accounts of users identified as repeat infringers.

This page outlines our notice-and-takedown procedures, explains how to submit a counter-notice and includes other relevant information.

Notification of copyright infringement

If you are a copyright owner or an agent thereof, and you believe that any content hosted on our website infringes your copyrights, then you may submit, in English, a notification pursuant to the 17 U.S.C. Section 512(c)(3) through our Content Report Form or by providing StreamYard Copyright Agent with the following information in writing:

  1. Your physical or electronic signature or that of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed
  2. Identification of the copyrighted work claimed to have been infringed
  3. Clear identification of the material that is claimed to be infringing that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit StreamYard to locate the material. Providing URLs to the alleged infringing content is the best way to help us locate content quickly
  4. Information reasonably sufficient to permit StreamYard to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted
  5. A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability. If you are unclear whether the content at issue is infringing, you should consider seeking independent legal advice.

Please note that the information you provide may be shared in good faith by us with the user who has committed the alleged infringement to allow them to submit a counter-notice. 

Counter-notification

If the content that you posted was removed for copyright infringement, you may send us a counter-notice to dispute the matter by submitting, in English, a notification pursuant to 17 U.S.C. Section 512(g)(3) through our Counter-Notice Form or by providing StreamYard Copyright Agent with the following information in writing: 

  1. Your physical or electronic signature
  2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of Federal District Court for the judicial district in which the address is located, or if your address is outside of the United States, for any judicial district in which StreamYard may be found, and that you will accept service of process from the person who provided notification or an agent of such person

Please note that we may send a copy of the counter-notice we receive to the person claiming that their copyrights are being infringed.

Content that has been removed will be reinstated if the party filing the original DMCA notice does not file a court action against the party who filed the counter-notice within fourteen business days of receiving the copy of the counter-notice.
